Terms of Service

1. What CuidaLink is — and what it is not

CuidaLink is a technology platform that helps families describe and qualify their in-home care needs, coordinates qualified requests with independent, licensed partner agencies that operate the care, provides independent caregivers with professional software tools ("Solo"), and offers training with verifiable certificates ("Academy"). CuidaLink is NOT a home health agency, nurse registry, or homemaker/companion services provider; NOT the employer or supervisor of any caregiver; NOT a provider of medical, nursing, legal, or emergency services; and NOT a party to any care services contract between a family and an agency or caregiver. The partner agency (or the caregiver a family engages directly) is solely responsible for licensing, insurance, hiring, screening, supervision, and delivery of care.

2. Accounts and eligibility

You must be at least 18 and able to form a binding contract. You are responsible for the accuracy of the information you provide and for safeguarding your credentials. We may suspend or terminate accounts that violate these terms or the platform rules: misrepresenting identity or credentials, endangering anyone, scraping or misusing data, spam, fraud, attacking the platform, or presenting an Academy certificate as a state license it is not.

3. Family requests and caregivers

Submitting a care request creates no obligation for CuidaLink or any agency. Availability, scope, pricing, contracting, and start of service are confirmed directly by the partner agency (see "Family Terms"). Caregivers using CuidaLink profiles or the Solo tools are independent professionals or agency employees — never CuidaLink employees or agents (see "Caregiver Terms").

4. Academy and certificates

Academy courses and certificates evidence completion of training content only. A certificate is not a professional license, a guarantee of employment, or a legal qualification to provide any specific service. Agencies and families must perform their own diligence.

5. Payments

Paid features (Solo Pro subscription, Academy course fees) are processed by Stripe. Prices are shown in USD; taxes may apply. Subscriptions renew automatically until cancelled. See the Refund & Cancellation Policy.

6. Emergencies

The platform is not monitored for emergencies. If someone is in danger, call 911. To report suspected abuse, neglect, or exploitation of an elderly or vulnerable adult in Florida, call the Florida Abuse Hotline at 1-800-962-2873. See the Safety & Verification policy.

7. Disclaimers and liability

The platform is provided "as is" and "as available." To the maximum extent permitted by law, CuidaLink does not warrant the conduct, qualifications, or performance of any agency, caregiver, or user, and CuidaLink’s total liability shall not exceed the greater of the amounts you paid CuidaLink in the 12 months before the claim or USD $100. CuidaLink is not liable for indirect or consequential damages, or for the acts or omissions of agencies, caregivers, families, or other third parties. You agree to indemnify CuidaLink against claims arising from your use of the platform or your interactions with other users.

8. Disputes, changes, and contact

Any dispute will be resolved exclusively in the state or federal courts of Miami-Dade County, Florida, under the laws of the State of Florida. We may update these terms; material changes will be notified via the platform or email, and continued use constitutes acceptance. Operated by CuidaLink (Rubén Gómez Espín), Miami, Florida — U.S. entity formation is in progress and this notice will be updated with the registered entity. Contact: rubengomezesp@gmail.com.
